Domain Registration Agreement for Hydra Hosting

This Domain Registration Agreement ("Agreement") governs the registration, renewal, transfer, and management of domain names through Hydra Hosting ("we," "us," or "our"). By registering a domain name through our services (the "Services"), you ("you" or "Registrant") agree to be bound by this Agreement, our Terms of Service, Acceptable Use Policy, Privacy Policy, and all applicable laws and regulations, including those of the Internet Corporation for Assigned Names and Numbers (ICANN). If you do not agree with these terms, do not use our domain registration Services.
1. Scope of Services
Hydra Hosting acts as an accredited registrar or reseller through an ICANN-accredited registrar to facilitate the registration, renewal, and transfer of domain names.
We provide domain management tools through our client portal, allowing you to manage DNS settings, contact information, and renewals.
Domain availability is subject to third-party registries and cannot be guaranteed until registration is complete.
Hydra Hosting acts as an accredited registrar or reseller through an ICANN-accredited registrar to facilitate the registration, renewal, and transfer of domain names.
We provide domain management tools through our client portal, allowing you to manage DNS settings, contact information, and renewals.
Domain availability is subject to third-party registries and cannot be guaranteed until registration is complete.
2. Registrant Responsibilities
You agree to:
Provide accurate, complete, and current information during registration, including your name, email address, postal address, and phone number, as required by ICANN’s Registrant Data policy.
Maintain and promptly update your contact information to ensure it remains accurate throughout the domain’s registration period.
Comply with all applicable laws, ICANN policies, and registry rules for your registered domain(s).
Respond promptly to inquiries from us or the registry regarding your domain registration or its use.
Use the domain in accordance with our Acceptable Use Policy, prohibiting illegal or abusive activities (e.g., phishing, malware distribution, or spamming).
3. Registration and Ownership
Registration Process: You select a domain name, and we attempt to register it on your behalf through the relevant registry. Registration is complete only upon confirmation from the registry.
Ownership: You are the registrant of the domain and retain ownership rights, subject to compliance with this Agreement and registry policies.
Third-Party Registries: Domain registrations are subject to the rules of the applicable registry (e.g., Verisign for .com, Nominet for .uk). You agree to abide by their terms.

4. Fees and Payment
Registration Fees: You agree to pay all fees associated with domain registration, renewal, or transfer, as displayed on our website at the time of purchase. Fees are non-refundable unless otherwise stated.
Renewal: Domains are registered for a fixed term (e.g., 1 year). You are responsible for renewing your domain before expiration. We will send renewal reminders to the email address on file, but failure to receive these does not relieve you of your obligation to renew.
Auto-Renewal: If enabled, your domain will automatically renew, and you will be charged the applicable fee unless you opt out through the client portal at least 7 days before the renewal date.
Fraud Prevention: We may use fraud detection tools (e.g., FraudLabs Pro) to verify transactions. Suspicious registrations may be delayed or canceled.

Redemption Period: Some domains may enter a redemption period after expiration, during which you may reclaim the domain for an additional fee. Availability and fees depend on the registry.
No Liability: Hydra Hosting is not liable for loss of a domain due to failure to renew or pay applicable fees.

6. Domain Transfers
Transfers to Hydra Hosting: You may transfer a domain to us, provided you comply with the current registrar’s transfer policies and pay any applicable fees.
Transfers Away: You may transfer your domain to another registrar, provided all fees are paid and you follow ICANN’s transfer policies. We may require identity verification to prevent unauthorized transfers.
Locking: Domains may be locked to prevent unauthorized transfers. You can manage locks through the client portal.
Transfers to Hydra Hosting: You may transfer a domain to us, provided you comply with the current registrar’s transfer policies and pay any applicable fees.
Transfers Away: You may transfer your domain to another registrar, provided all fees are paid and you follow ICANN’s transfer policies. We may require identity verification to prevent unauthorized transfers.
Locking: Domains may be locked to prevent unauthorized transfers. You can manage locks through the client portal.
7. Domain Name Disputes
ICANN Policies: You agree to comply with ICANN’s Uniform Domain-Name Dispute-Resolution Policy (UDRP) and other applicable dispute resolution policies of the relevant registry.
Dispute Resolution: If a third party claims your domain infringes their rights, we may suspend or transfer the domain as required by the UDRP or a court order.
No Liability: We are not liable for any loss or damages arising from domain disputes or their resolution.
ICANN Policies: You agree to comply with ICANN’s Uniform Domain-Name Dispute-Resolution Policy (UDRP) and other applicable dispute resolution policies of the relevant registry.
Dispute Resolution: If a third party claims your domain infringes their rights, we may suspend or transfer the domain as required by the UDRP or a court order.
No Liability: We are not liable for any loss or damages arising from domain disputes or their resolution.
8. WHOIS and Data Accuracy
WHOIS Data: You agree to provide accurate WHOIS information as required by ICANN. Failure to maintain accurate data may result in domain suspension or cancellation.
Privacy Services: If offered, you may opt for WHOIS privacy protection to mask your contact details in public WHOIS records, subject to additional fees and registry rules.
Disclosure: We may disclose your WHOIS data to comply with legal requirements, ICANN policies, or to resolve disputes.
WHOIS Data: You agree to provide accurate WHOIS information as required by ICANN. Failure to maintain accurate data may result in domain suspension or cancellation.
Privacy Services: If offered, you may opt for WHOIS privacy protection to mask your contact details in public WHOIS records, subject to additional fees and registry rules.
Disclosure: We may disclose your WHOIS data to comply with legal requirements, ICANN policies, or to resolve disputes.
9. Prohibited Uses
You may not use a domain registered through our Services for:
Illegal activities, including but not limited to phishing, fraud, or distribution of illegal content.
Activities that violate our Acceptable Use Policy, such as spamming or hosting malware.
Misrepresenting your identity or engaging in deceptive practices.
10. Limitation of Liability
To the fullest extent permitted by law:
Hydra Hosting is not liable for any indirect, incidental, or consequential damages (e.g., loss of business) arising from domain registration, expiration, or disputes.
Our total liability shall not exceed the fees paid by you for the domain registration in the preceding 12 months.
We are not responsible for domain loss due to registry actions, third-party disputes, or your failure to renew or maintain accurate WHOIS data.
11. Indemnification
You agree to indemnify and hold harmless Hydra Hosting, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Services, violation of this Agreement, or infringement of third-party rights.
12. Modifications to Agreement
We may update this Agreement at any time to reflect changes in our Services, ICANN policies, or legal requirements. Updates will be posted on our website, and significant changes will be communicated via email or account notifications. Continued use of the Services after changes constitutes acceptance of the updated Agreement.
13. Governing Law
This Agreement is governed by the laws of the Cayman Islands, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Cayman Islands.

By registering or managing a domain name through Hydra Hosting’s Services, you acknowledge that you have read, understood, and agree to be bound by this Domain Registration Agreement.
